1. Terms
A. By accessing hostthebest.com you agree that you will abide by the following
Terms of Service rules set out on this page. Please note that if you do not
understand anything on within our Terms and Conditions, Privacy Policy or Refund
Policy then you can email us at [email protected] and we will do our best
simplify it for you in a way which you will understand.
B. We hold the right to update our Terms of Service without prior notification
to current and/or potentional customers.
C. Host The Best cannot and will not be held responsible for loss of data under any
circumstances as we do not offer a backup service We will always do our best to
ensure this does not happen although hard drives do fail and we are unable to
always recover all data. If it is possible for us to recover any data then we
would always do this first. If we come across any issues which could or has
resulted in you loosing your data then we would send you an email to notify you.
D. Breaking any of these terms will give Host The Best the right to
suspend/terminate any related product/service and all products/services on your
account shall be suspended. We can then access your account and check through
ALL files on your service. After a full thorough search of your account, if it
does not hold prohibited items on the service then it shall be unsuspended. If
it holds illegal content then we will record proof and report you to the
respectful owners. We may then suspend or terminate your account without a
refund as this was not a fault of ours.
E. If you are a reseller of any of our services, then you and your customers are
subject to all of our terms and conditions. Please be sure to make all of our
terms and conditions and our privacy policy within your terms and conditions and
privacy policy.
2. Services Included
A. These terms have been created and are applied, but not limited to the
following services:
Web Hosting
Reseller Web Hosting
Virtual Private Servers
Domain Names
Dedicated Servers
Colocation
3. Use License
A. Whilst using a product bought from Host The Best you will be unable to use our
products for providing the following services:
IRC egg drops
Mail bombers
DDoS Attacker / Booter
Port scanners
Hivemail
Telnet or SSH Access Scripts
nph-proxy (and other scripts what operates like proxy)
UBB (Ultimate Bulletin Board, all versions)
lstmrge.cgi
phpShell
FormMail.cgi, FormMail.pl from Matt's Script Archive are not allowed.
Mass-mailing (Spam)
Warez (Of any kind is not permitted unless you can prove you have permission to
use or redistribute.)
B. Potential or existing customers may not use our products and services for any
of the following and if done so, services shall be suspended immediately:
Performing Illegal Activities i.e Fraud, DDoS Attacks, Connection Flooding or
Booting, Hacking, Scripting, Intruding on the privacy of others, Computer
Infections, Human Trafficking, Illegal Substances, Money Laundering, Copyright
infringement and other such illegal activities.
Resell any of our products.
Hosting Illegal Content i.e Child Pornography, Phishing Websites/Services,
Unauthorised Product Giveaway.

By using Host The Best, you agree to the Terms of Service above and accept that any
high-usage virtual servers on your account will have the extra charges added on
top. We may update our TOS at any time without notifying our clients so you
should check this page regularly for updates!
4. Refund Policy
By purchasing any content from this website, or any websites linked with
Host The Best you agree to our terms of service.
We understand that you may not be satisfied with a product, or you may not need
it any longer. We offer refunds on most of our products, but it is not possible
on some of the services/products that we provide.
Please review the information below which states our refund policy.
5. Host The Best Account Credit / Add Funds
If you have funds available in your Host The Best Billing account, then this can be
refunded back to you, but there is a 20% holding fee. The payment can only be
refunded back to the payment gateway which you originally paid through.
6. Web Hosting Services
If you are not satisfied with your web hosting service, or you wish to cancel
it, then you would normally be eligible for a refund for each unused day
remaining on your service starting from the time we receive the cancellation
request and support ticket requesting a refund. Please note that refunds are
only given if your service has been active for less than 30 days. Refunds would
be given as credit to your Host The Best account or refunded via. the method you
used to make the payment. We will not make any refunds to any other payment
gateway other than Host The Best account credit or the payment gateway you used to
make the payment.
7. Reseller Web Hosting Services
If you are not satisfied with your reseller web hosting service, or you wish to
cancel it, then you would normally be eligible for a refund for each unused day
remaining on your service starting from the time we receive the cancellation
request and support ticket requesting a refund. Please note that refunds are
only given if your service has been active for less than 30 days. Refunds would
be given as credit to your Host The Best account or refunded via. the method you
used to make the payment. We will not make any refunds to any other payment
gateway other than Host The Best account credit or the payment gateway you used to
make the payment.
8. Virtual Private Servers and Dedicated Servers
We do not offer refunds on any of our Virtual Private Servers or Dedicated
Servers unless the immediate cancellation request is received before we have
setup your service and marked your order as active. We will not downgrade a
virtual private server or dedicated server, although we can offer an upgrade of
your service (unless a member of the management agrees to downgrade the
service). If the virtual server is downgraded, an operating system reinstall
will be required and an additional fee may be charged. If a downgrade is
approved, we will only issue you with account credit which cannot be withdrawn.
(Where there is monetarily a difference)
All of our Windows VPS comes with a Support account as standard, this account
will be for Host The Best Support team and Staff to be able to gain access to your
VPS when required. Without this account we will be unable to access your VPS and
this will mean if you forget your VPS Password or need us to assist you within
your VPS, then we will be unable to assist. We ask that you do not delete or
change the password to this account as doing so will require a OS reinstall
before we are able to assist you. If you do not want to loose your data then we
will be able to force a password change on your VPS, but this would incur a
charge of �10.00 GBP. This fee is not refundable, and is only charged once upon
each time we are required to change your password using this method. If you are
locked out of your VPS and and we are unable to gain access then please contact
support by opening a support ticket requesting for us to reinstall your OS, and
agreeing to loosing all of your data or you can alternatively request a force
password change by simply ordering the 'Force Password Change' addon or by
contacting the Billing Department. Upon receipt we will start the force password
process and reply back with your new password.
Windows VPS does not include a Microsoft Windows License. If you rent one of our
VPS with Microsoft Windows installed then we automatically assume that you are
going to be using your own Microsoft Windows License. When you receive your
Windows VPS we will automatically activate a Microsoft Windows Evaluation
License which will give you 180 days. If your Microsoft Windows Evaluation
License expires, then we are able to extend the evaluation period upon receiving
a support ticket. If you avoid buying a Microsoft Windows License, then upon
expiry of the evaluation period, your Windows VPS will automatically shut down
once every 12 or 24 hours until you activate your license. If you would like to
purchase a Microsoft Windows SPLA License from us, then please submit a support
ticket for pricing information. Please understand that we do not include a
Microsoft Windows License with our Windows VPS due to incredibly low pricing.
10. Domain Names
Domains are non-refundable without exception. If you purchased hosting with your
domain name, we will refund the hosting as stated in the "Web Hosting Services"
section of this document. We will also offer to transfer the domain name, but an
additional fee will apply for the transfer.
